All services provided by RCTHost.com may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless RCTHost.com and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography and sex-related merchandising is prohibited on all RCTHost.com servers. This includes sites that may infer sexual content, or links to adult content elsewhere. RCTHost.com will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to RCTHost.com servers or any other server on the internet. Links to such materials are also prohibited.

The following content will not be tolerated on our servers:

Software Programs Unless Created by the Client and Contained in a Zip File This does not include scripts such as php or cgi. First minor violation will result in deletion of offending content, and account suspension. To have your account reactivated we require you to fax us a signed agreement to the Terms of Service. Second violation will result in account termination and ban from RCTHost.com. First severe violation such as a large number of commercially copyrighted software files will result in immediate termination and ban from RCTHost.com services.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to RCTHost servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

- Pirated software
- Hacker programs or archives
- Warez sites
- Scams
- IRC Bots
- Insecure FormMail Scripts
- Insecure PHP Scripts

RCTHost.com will be the sole arbiter as to what constitutes a violation of this provision.

The following content is NOT permitted to be hosted on a standard shared hosting account:

Any Audio or Video Files. Period. No Exceptions. Flash and small audio files with flash is ok. Links to audio or video is ok. No zip files containing audio or video. No exceptions. Please do not ask. The answer is No. Even if you made it, you still cannot host it. First violation will result in deletion of offending content, and account suspension. To have your account reactivated we require you to fax us a signed agreement to the Terms of Service located here. Second violation will result in account suspension. After the second violation you must pay a $25 reactivation fee in order to get your account back.

File types not allowed on standard hosting service are (but not limited to): .mp3 .avi .mpg .mpeg .mov .asf .ra

Any content that is considered to be offensive. This includes but is not limited to pornography and sex-related merchandising. Non-nude teen sites, bikini sites, or anything similar are also not allowed. First violation will result in account termination without refund and ban from our servers. NO ADULT CONTENT! 

Media hosting account terms:

Clients with a Media hosting account may upload and store personal uncopyrighted audio & video files. No copyrighted files permitted.

Resource Usage
To keep service at peak performance for all clients we do not allow high traffic sites. If you are monopolizing CPU resources or system memory your account will be suspended and you will be asked to find a new host.

Accounts exceeding 10% CPU or memory usage for more than 24 hours may be subject to a resource usage audit. RCTHost.com will use it's judgment and sole discretion in suspending, terminating, and refunding violators.

RCTHost.com reserves the right to refuse or discontinue service to anyone for any reason. In most cases a pro-rated refund minus any applicable cancellation fees will be offered to any client we refuse service to that is already an RCTHost.com client.

CGI Based BBS/Forums
CGI based forums are prohibited from RCTHost.com servers because the drain system resources causing frequent server crashes.

Account Suspension
If we are unable to contact a client or do not get proper cooperation from a client in regards to billing or TOS violations, we will suspend the client's account until the matter is resolved.

MLM (Multi-Level Marketing)
MLM websites are strictly forbidden on any RCTHost.com server. These sites generally are scams and use our SMTP services for SPAM. RCTHost.com will be the sole arbiter as to what constitutes a violation of this provision. 

E-mail
Spamming, or the sending of unsolicited e-mail including, without limitation, commercial advertising and informational announcements, from an RCTHost.com server or using an e-mail address or domain that is maintained on an RCTHost.com machine as reference is strictly prohibited. RCTHost.com will be the sole arbiter as to what constitutes a violation of this provision. A user shall not use another site's mail server to relay mail without the express permission of the site. RCTHost.com will be the sole arbiter as to what constitutes a violation of these provisions.

SPAMMING WILL RESULT IN IMMEDIATE TERMINATION OF YOUR ACCOUNT WITHOUT REFUND!

Use of RCTHost.com Resources
You may not resell or giveaway any of RCTHost.com resources without permission. This includes but not limited to: webspace, sub-domains, and pop3 accounts. If you are unsure, ask us.

Multi-Domain Hosting
You may add-on or park as many domains as you have allowance for but you must own and operate every domain yourself. You cannot host domains that you do not own and operate. You may not resell hosting from a personal account.

System And Network Security
Any attempt to undermine or cause harm to a server, or customer, of RCTHost.com is strictly prohibited.

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Limitation Of Liability
RCTHost.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from RCTHost.com servers going off-line or being unavailable for any reason whatsoever. Furthermore, RCTHost.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of RCTHost.com servers. All damages shall be limited to the immediate termination of service. RCTHost.com may or may not regularly backup files on server hard drives and these backups may or may not be available to restore. Backups are the sole responsibility of the client.

Violations of these Acceptable Users Policies should be referred to Abuse@RCTHost.com.

All complaints will be investigated promptly.
Failure to follow any term or condition may be grounds for immediate account deactivation.

Disclaimer
RCTHost.com cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by RCTHost.com are resold. Thus, certain equipment, routing, software, and programming used by RCTHost.com are not directly owned or written by RCTHost.com. RCTHost.com holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as RCTHost.com sees fit.

Account Activation
By activating your account with RCTHost.com, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer and a copy of your acceptance is forwarded along with your activation request to be maintained within your account information.

Technical Support Limitations
We will not debug or analyze scripts of any kind. If you are going to be using scripts, you should be an experienced programmer. 

Log File Policy
Logs are cleared after stats run each night or every other night.  

"As Is" Policy
All of RCTHost.com services are provided "as is". You may submit special install requests, but it is not guaranteed that it will be done.

Cancellation and Refunds
You may cancel your account at anytime. Refunds will not be given after the first 30 days of your account activation (for accounts opened after 6/26/03 only. Accounts opened before 6/26/03 have a 14 day money back guarantee). If you choose to cancel your account just let us know BEFORE your next billing cycle. If your account is less than 30 days old you will qualify for a refund. In some cases we may charge a $5 processing fee.

Be aware that we do not offer refunds on renewal fees paid after the first year, no exceptions! You MUST cancel BEFORE your renewal date if you do not want to renew.

ALL CANCELLATION REQUEST MUST BE SENT VIA THE HELPDESK - EMAILED CANCELLATION REQUESTS WILL NOT BE HONORED

Chargebacks
DO NOT perform a chargeback with your bank if you failed to cancel your recurring bill before your renewal date. By agreeing to our terms, you agree to NOT perform a chargeback and you agree that if you do perform a chargeback you WILL be required to pay the chargeback fee of $25 that we incur. There is no exception to this term.

Unlimited Resource Policy
RCTHost.com can no longer offer anything "unlimited". If you had a plan with unlimited disk space or any other feature a cap has been set. This does not mean it is a permanent cap. Simply ask us to raise your limits if and when you need more. This applies only to clients who purchased a plan with unlimited disk space or other features.

Abandoned Account Policy
In the event that an account has not been used for a substantial period of time and the domain is resolving to an IP not on the RCTHost.com network, RCTHost.com has the right to terminate or suspend that account.

PayPal Subscriptions
If you sign up through PayPal it is VERY important that your subscription remain active to insure your hosting account remains active. If you cancel your subscription you will need to re-signup at the end of your term, but you will have to choose one of our current plans at current prices. Keep in mind that certain changes you make to your PayPal account can cause subscriptions to be automatically cancelled. You must cancel before your next billing period. It is the clients responsibility to cancel any PayPal subscriptions that are active after canceling service.

Renewal Policy
Renewal payment is due on your anniversary date. In most cases you will be automatically re-billed. If you paid by credit card you will be emailed 5 days prior to your billing date. The email sent to you will include a link to update your billing information in case anything has changed. It is the clients responsibility to promptly pay all renewal fees. If payment is not received by the renewal date the account will be suspended until payment is received. If payment is not received within 2 weeks the account will be removed from the server.

If you sign up for an account and do not follow our terms, no refunds will be given.
